Terms of Service

1. Acceptance of Terms

By accessing or using Omen ("the Platform"), operated by Yung Entertainment GmbH ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Omen is a platform for young creators to build, publish, and share interactive creations. The Platform provides digital identity, user profiles, social features, a virtual item system, a daemon system, and tools for developers to integrate with Omen's services. Omen also provides hosting for user-created content, a virtual currency system (Omen Sparks), and a marketplace for digital goods.

3. Eligibility and Accounts

You must be at least 13 years old to use Omen, or have parental consent if under 13. Users under 18 may be designated as child accounts, which are subject to additional parental controls described in Section 16.

You are responsible for maintaining the security of your account and all activity that occurs under it. You may not share your credentials or allow others to access your account.

4. Authentication

Omen supports multiple authentication methods:

• Cryptocurrency Wallets: You may connect a Solana wallet by signing a message to verify ownership. This is a gas-less, read-only operation that does not grant Omen access to your funds or private keys.
• OAuth Providers: You may sign in with Discord, Twitter/X, or other supported providers. We receive limited profile information as authorized by you.
• Email Magic Links: You may sign in via a one-time link sent to your email address.
• Transfer Authentication: You may authenticate by sending a micro-transaction to a designated address for wallet verification.

5. Account Linking

You may link multiple authentication methods (wallets, OAuth providers, email) to a single account. You are responsible for maintaining the security of all linked accounts and credentials. Linking a new authentication method to an existing account is permanent unless you contact support.

6. Usernames and Profiles

You may claim a unique username for your profile. Usernames must be 3-20 characters, alphanumeric with optional hyphens and underscores, and may not impersonate other users or brands. We reserve the right to reclaim usernames that violate these rules.

Username changes are limited to once every 30 days. Your old username is reserved for 30 days after a change and old vanity domain URLs redirect during that period.

Your public profile may display your username, avatar, bio, creations, collectible items, badges, daemon, mood/status, and social connections depending on your privacy settings.

7. User-Generated Content

You retain ownership of content you create and publish on Omen, including creations, profile information, and descriptions. By publishing content on Omen, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and make your content available to other users in accordance with your visibility settings.

You are solely responsible for content you publish. Content must not violate any applicable laws, infringe third-party rights, or contain malicious code, adult material, harassment, or personal information of others.

8. Creations and Publishing

Omen allows you to publish interactive creations that are hosted on Omen's infrastructure or linked as external URLs.

• Omen-Hosted Creations: Uploaded files are subjected to automated security scanning (file validation, static analysis, and AI-assisted review) before being made available. You must approve each publish via QR code or the web approval flow.
• External Creations: You may link to externally hosted content via HTTPS URLs. External content is displayed through an interstitial warning page. Omen does not control, endorse, or assume responsibility for external content.

Creations are served on subdomains (e.g., username.omen.page) within a sandboxed iframe. Creations must not attempt to impersonate Omen's user interface or mislead users about their origin.

9. Content Moderation

All published creations are subject to automated security scanning and community reporting. We enforce a progressive discipline system:

• First violation: Warning and content removal
• Second violation: Account placed under review
• Third violation: Publishing privileges disabled

We reserve the right to remove any content and suspend or terminate any account at our sole discretion if we determine the content or conduct violates these terms or poses a risk to other users. Users may report content via the report button on any creation.

10. Items and Collectibles

Omen provides a virtual item system that allows applications to issue, manage, and transfer digital collectibles to users. Items exist within the Omen platform and have no inherent monetary value outside of it.

• Items may have rarity tiers, supply limits, and expiration dates set by their issuing application.
• Items may be transferred between users via signed transfer links or QR-based redeem codes, subject to the sender's and recipient's account restrictions.
• Expired or revoked items remain visible in your inventory but become unusable.
• For child accounts, item transfers require parental approval.

11. Virtual Currency (Omen Sparks)

Omen Sparks ("Sparks") are a virtual currency used within the Platform. The following terms apply:

• No cash value: Omen Sparks have no real-world monetary value and cannot be redeemed, refunded, or exchanged for real-world currency under any circumstances. This is a permanent policy.
• Starter Sparks: New accounts receive a one-time grant of starter Sparks. These are non-refundable and non-transferable.
• Purchases: You may purchase Sparks with real money through Stripe. All purchases are final. Refunds are issued only at our discretion and in accordance with applicable law.
• Spending: Sparks can be spent on digital goods within creations and the Omen Store. Purchases are final once confirmed.
• Account termination: If your account is terminated, any remaining Sparks balance is forfeited.
• Child accounts: Sparks purchases and spending by child accounts may require parental approval, subject to family account settings.

12. Creator Earnings

Creators earn Sparks when users spend Sparks within their creations. The revenue split is as follows:

• 70% goes to the creator as direct earnings.
• 30% is retained as a platform fee, allocated to the Creator Fund (weekly distribution to active creators based on verified engagement), platform operations, and supply management.

Creator earnings are denominated in Sparks and are subject to the same no-cash-value policy. The Creator Fund distributes a portion of platform fees weekly to creators based on verified user engagement with their creations. Self-play and fraudulent engagement are excluded from Creator Fund calculations.

13. Omen Store

The Omen Store offers digital cosmetic items including profile themes, daemon accessories, and profile flair, purchasable with Sparks. All store purchases are final. Seasonal or limited-edition items may be available for a restricted time but are owned permanently once purchased. Store items are cosmetic only and provide no competitive advantage.

14. Subscriptions (Omen Plus)

Omen may offer subscription plans that provide monthly Sparks grants, exclusive cosmetic items, and additional features. Subscriptions auto-renew monthly unless cancelled. Exclusive items received during an active subscription are kept permanently, even after cancellation. Subscription pricing and benefits are described on the relevant purchase page and may change with notice. All subscription payments are processed through Stripe.

15. Social Features

Omen provides social features including friends, presence indicators, activity feeds, and real-time multiplayer. By using these features:

• Your online status and current activity may be visible to friends, subject to your privacy settings.
• Activity events (such as earning items, publishing creations, or adding friends) may appear in friends' feeds.
• You may block other users, which prevents mutual visibility and interaction.
• Multiplayer rooms enable real-time communication with other users within creations. Messages in multiplayer rooms are ephemeral and not permanently stored.

16. Daemon System

Each user may have a virtual daemon that evolves based on their creative activity on the platform. Daemons develop personality traits, earn badges, and unlock cosmetic accessories over time. Daemon data (activity stats, traits, appearance, badges) is associated with your account. Daemons are displayed on your profile and home page.

17. Child Safety and Family Accounts

Omen is designed to be safe for young creators. Child accounts are subject to additional protections:

• Parental controls: Parents can manage app approvals, spending limits, item transfer approvals, push notification settings, and friend request approvals for child accounts.
• Content safety: Child-published creations undergo additional PII scanning. Stricter Content Security Policies are applied to child-hosted content.
• Friend approval: Friend requests involving child accounts require parental approval.
• Transfer approval: Item transfers to child accounts require parental approval.
• Purchase controls: Sparks purchases and spending by child accounts may require parental approval.
• External content: Child accounts see additional safety warnings before visiting external creations.

Parents can monitor their child's activity, inventory, and friend connections through the family management interface.

18. Third-Party Applications

Developers may create applications that integrate with Omen via our OAuth 2.0 API. When you authorize a third-party application:

• The application may access your profile information, items, and other data as described on the authorization screen.
• The application may issue items to your inventory, store per-user data, and send notifications.
• The application may offer products for purchase via Stripe checkout. When you buy from a third-party app, payment is processed through the developer's Stripe connected account. Upon successful payment, the purchased item is automatically issued to your inventory.
• You can revoke an application's access at any time from your account settings.
• Third-party applications are governed by their own terms of service and privacy policies. Omen is not responsible for the conduct of third-party applications.

19. Developer Obligations

If you register as a developer and create applications on Omen, you agree to:

• Provide accurate application information, including a terms of service and privacy policy URL.
• Respect user privacy settings and data access permissions.
• Not abuse API rate limits (100 requests/minute per session, 1,000 requests/minute server-to-server).
• Secure your application credentials (client ID and secret). You are responsible for all activity performed using your credentials.
• Use webhook data (signed with HMAC-SHA256) only for the purposes authorized by the user.

20. Prohibited Conduct

You agree not to:

• Publish malicious content, malware, phishing pages, or content that impersonates Omen's interface.
• Harass, threaten, or abuse other users.
• Attempt to gain unauthorized access to other accounts or platform systems.
• Create multiple accounts to circumvent bans, abuse starter Sparks grants, or manipulate the Creator Fund.
• Use bots or automated tools to artificially inflate engagement metrics, stars, or presence.
• Publish content that infringes copyrights, trademarks, or other intellectual property rights.
• Use the Platform for any unlawful purpose.

21. Copyright and DMCA

We respect intellectual property rights. If you believe content on Omen infringes your copyright, you may submit a takedown request to our contact address with: (a) identification of the copyrighted work, (b) identification of the infringing content, (c) your contact information, and (d) a statement of good faith belief that the use is not authorized. We will review and respond to valid requests in accordance with applicable law.

22. Intellectual Property

All Omen branding, technology, design, and platform content (excluding user-generated content) are the property of Yung Entertainment GmbH or its licensors. You may not reproduce, distribute, or create derivative works of Omen's platform materials without prior written consent.

23. Termination

We may suspend or terminate your account at any time for violation of these terms, at our sole discretion. Upon termination:

• Your creations will be removed from public hosting.
• Your profile will no longer be publicly accessible.
• Any remaining Omen Sparks balance is forfeited.
• Items in your inventory remain in the system but become inaccessible.
• You may request export of your personal data in accordance with applicable law.

You may delete your account at any time through your account settings. Account deletion is permanent and cannot be undone.

24. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the service, the safety of external creations linked by users, or the accuracy of content published by users or third-party applications.

25. Limitation of Liability

To the fullest extent permitted by law, Yung Entertainment GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of digital assets, loss of virtual currency, loss of data, or damages arising from third-party content or applications.

26. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via the Platform or email. Continued use of the Platform after changes constitutes acceptance of the updated terms. If you disagree with changes, you may delete your account.

27. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
